Certain actions, such as the
sale of significant Town proper-
ty, on the part of a Town Board
may be subject to what is called
a permissive referendum. That
is, a petition, signed by Town
residents representing 5% of
those who voted in the last gu-
bernatorial election, may require
a vote be held on that particular
issue. Let me explain the issue
at hand through a matter-of-fact
chronology of the events.
At its January, 2013, meeting,
the Board reviewed a list of pri-
orities for the year. One of those
was to determine the disposition
of approximately 118 acres of
land off theWest side of Neid Rd.
At one time, this was an active
quarry and then purchased by
the Town of LeRoy to serve as
its metal/wood dump. The Town
ceased its dump operations there
in the 1990s and it has sat vacant/
inactive since.
In my May, 2013,
Pennysaver
column, I announced that the
board members would be tour-
ing the site in consideration of
its sale. In mid-June, 2013, we
toured the old dump. At our July
11, 2013, meeting the issue was
on the agenda and the Board
unanimously agreed to pursue
the sale of the property. On the
first of December, 2013, an ad
was placed in the
LeRoy Pen-
nysaver
(approx.. 100+ acres,
tax map # 26.-1-3, zoned I-1,
assessed value approx. $84,500)
seeking purchase offers and
directing such to the Town At-
torney. The Town received two
offers, one for about $95,000 and
one for about $46,000.
At the March, 2014, LeRoy
Business Council meeting, I in-
formed the group of the pending
sale and they recommended the
Board pursue such. On May 8,
2014, the Town Board accepted
the purchase offer of $95,000
from Mr. John Zoladz, whose
company’s intent is to use the
property for the grinding of mu-
nicipal green waste into mulch
(cut trees, leaves, etc.) and re-
cycling of concrete (disposed
sidewalks, etc.). The purchaser
would thereafter be responsible
to pursue any necessary permits
from DEC and/or any zoning
amendments (Planning Board)
required by Town Code. At its
August 14, 2014, meeting the
Town Board accepted a petition,
signed by the required number of
petitioners, seeking a vote on the
sale of the property.
Therefore, in following proper
legal process, there will be a pub-
lic vote, for any registered voter
residing in the Town of LeRoy,
at the Town Hall (48 Main St.),
on Tuesday, October 21, 2014,
between the hours of 12:00
noon and 8:00 pm, to decide the
following:
“Shall the Town of LeRoy be
permitted to sell its property lo-
cated at TaxMap #26.-1-3 to John
Zoladz for the sum of $95,000?
YES_____ NO_____
The effect of this proposition is:
If the majority of those voting
on the proposition vote “NO”,
the contract between the Town
and John Zoladz shall be null
and void.
On the other hand, if the major-
ity of those voting on the propo-
sition vote “YES”, the contract
will undergo further review under
the State Environmental Quality
Review Act prior to proceeding
to closing.”
Also, as I mentioned earlier, the
Town has taken possession of an
abandoned RR bed that it hopes
to turn into a greater regional
recreation trail. At present, the
area is posted, but the Highway
Dept. will be doing some clearing
work this fall in preparation for,
hopefully, use next summer.
Finally, a hearty congratula-
tions to the LeRoy Moose (and
thank you for your civic service
activities) on its Centennial cele-
bration and to our 46th LeRoyan
Award winner- Nancy Baker. I
pretty much grew up as Nancy’s
(and Dr. Baker) children did so
I know first-hand how much she
has contributed to LeRoy over
the years. From the Town Board
