LE ROY PENNYSAVER & NEWS - MAY 12, 2019 Police Report 23-year-old, Steven D. Smires, of no permanent address was arrested onMay 02, 2019 by the Le Roy Police Department and charged with one count of Endangering the Welfare of a Child, a Class A Misdemeanor and one count of Unlawful Possession of Marihuana, a Violation. 38-year-old, Leah M. Burrus-Stewart, also of no permanent address, was arrested as a result of the same incident and charged with one count of Endangering the Welfare of a Child, a Class AMisdemeanor. At approximately 11:30 am on May 02, 2019, the Le Roy Police Department received a complaint of a subject smoking marihuana in a vehicle with two small children. Upon arrival patrols located a vehicle parked in a municipal parking lot located in the Village and inside the vehicle they located Smires and Burrus-Stewart along with a three-year-old child belonging to Burrus-Stewart and a nine- month-old child that belonged to the couple. It is alleged that prior to the patrols arrival Smires had been smoking marihuana in the vehicle with both children present inside the vehicle. At the time Smires was smoking marihuana, Burrus- Stewart was also inside the vehicle. Patrols also located marihuana and paraphernalia used for smoking marihuana inside the vehicle. During the investigation it was also discovered that Smires, Burrus- Stewart, and both the children did not have housing and had been living in the vehicle. Both Smires and Burrus-Steward were arrested without incident and Child Protective Services was contacted to assist with the care of the children. Both Smires and Burrus- Stewart were arraigned in the Le Roy Town Court in front of the Honorable Judge Sehm and turned over to the Genesee County Jail in lieu of $750 bail. They are to return to the Le Roy Town Court on June 04, 2019 to answer to the charges. 35-year-old, Donald G. Cooper and 34-year-old Christine A. M. Wark, of School Street, Le Roy, were arrested on May 03, 2019 by the Le Roy Police Department and charged with four counts each of Endangering the Welfare of a Child, a Class A Misdemeanor, Cooper was also charged with an additional charge for Unlawful Possession of Marihuana, a Violation. In the evening of May 03, 2019 at approximately 10:30 pm the Le Roy Police Department received a complaint of two young children sitting on the side of the road on State Route 19. When patrols arrived in the area, they located two children, ages eight and ten years old. Patrols were able to identify and locate the parents of the children at which time it was discovered that the children were allegedly sent out of the residence to burn off some energy while retrieving a discarded item located on the side of the road approximately a half mile from their residence. During the investigation an unsecured firearm along with bullets for the firearm was located in the residence where both children reside, the firearm and bullets were placed in a location that was accessible to both children. Paraphernalia used for smoking marihuana was also located in the residence and accessible to both children. As a result of the significant disregard for both children’s well being both Cooper and Wark were placed under arrest without incident. Cooper and Wark were arraigned in front of the Honorable Judge Sehm and released under the supervision of Genesee Justice. Cooper and Wark are to return to the Le Roy Town Court on June 04, 2019 to answer to the charges.
